Privacy Policy

Privacy Policy. The RateMyStudyAbroad, LLC (“RateMyStudyAbroad”) Privacy Policy covers RateMyStudyAbroad’s treatment of personal or personally identifiable information (“Personal Information”) that may be collected when you use the RateMyStudyAbroad web site or any other RateMyStudyAbroad service. This Policy does not apply to the practices of companies that RateMyStudyAbroad does not own or control, nor does it apply to individuals that are not under RateMyStudyAbroad’s supervisory control.

1. Collection and Use of Personal Information. RateMyStudyAbroad may collect Personal Information when you use certain services on the RateMyStudyAbroad web site or when you visit cookie-enabled web pages. RateMyStudyAbroad may also log your IP address when you use the RateMyStudyAbroad web site. RateMyStudyAbroad uses this Personal Information to fulfill requests for our services or products, to contact users regarding changes to our site or our business and to customize the content that you might see on the RateMyStudyAbroad web site. RateMyStudyAbroad may also use “cookie” files to better serve your needs by creating a customized web site that best fits your needs.

2.Sharing and Disclosure of Personal Information. RateMyStudyAbroad will not sell or rent your Personal Information to any individual, business, or government entity. 3.User Accounts. RateMyStudyAbroad allows users to set up personal accounts to participate in our on-line community, such as our message boards and rating program. When you set up your personal account, you will be asked to provide certain Personal Information (“User Information”). You have the ability to edit your User Information at any time and may delete your account at your convenience. Under no condition will RateMyStudyAbroad share your User Information with another individual, business or government entity unless RateMyStudyAbroad is required to respond to court orders, subpoenas or other legal process.

4.Password Protection. All user accounts must be accessed with usernames and passwords. You are advised not to share your username and password with any other person.

5.Amendments. RateMyStudyAbroad reserves the right to amend this policy at any time without notice.

Terms of Use

1.Acceptance of Terms of Use. RateMyStudyAbroad, LLC (“RateMyStudyAbroad”) provides its on-line services and web site to you, the User, subject to this Terms of Use Agreement (“TOU”). RateMyStudyAbroad reserves the right to alter the TOU at any time without notice to User. By using the RateMyStudyAbroad web site, located at the URL http://www.ratemystudyabroad.com, User agrees to abide by this TOU Agreement.

2.On-line Services and Disclaimer of Warranty. The RateMyStudyAbroad web site provides on-line resources including, but not limited to, on-line feedback, ratings and information pertaining to study abroad programs. Any new services, resources or informational content added to the web site shall fall under the terms of this TOU Agreement. The on-line resources, informational content, and software on this web site is provided “AS IS”, AND ALL WARRANTIES, EXPRESS OR IMPLIED, ARE DISCLAIMED, INCLUDING, BUT NOT LIMITED TO, ANY IMPLIED WARRANTIES OF MERCHANTABILITY, MERCHANTABILITY OF ANY COMPUTER PROGRAM OR SOFTWARE, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY OF INFORMATIONAL CONTENT, OR SYSTEM INTEGRATION, OR NON-INFRINGEMENT. RateMyStudyAbroad assumes no responsibility for any data loss or other loss suffered by any User of this web site. User is fully responsible for maintaining its computer equipment and Internet access to use the RateMyStudyAbroad web site.

3.Registration. Certain areas of the RateMyStudyAbroad web site are provided solely to registered Users of the web site. Any User registering for such services agrees to provide true and accurate information during the registration process. RateMyStudyAbroad reserves the right to terminate the access of any User should RateMyStudyAbroad know, or have reasonable grounds to suspect, that the User has entered false or misleading information during the registration process. ALL REGISTERED USERS MUST BE OF LEGAL AGE TO REGISTER. Children under the age of 18 shall not be permitted to register unless they do so under the strict supervision of a legal guardian. RateMyStudyAbroad maintains strict on-line Privacy Policy and will not sell or give your information to other parties.

4.User account. User shall select a username and password upon completing the registration process. User is fully responsible for maintaining the confidentiality of their username and password. Users agree to immediately notify RateMyStudyAbroad at Henryvw1@gmail.com or jackandrewmartin@gmail.com should User know or have reasonable grounds to suspect that their username and password have been compromised. RateMyStudyAbroad is not responsible for User’s negligence or failure to abide by this Paragraph.

5.Informational content supplied by Users. User understands that all information, computer files, software, graphics, sound files, and text, whether publicly displayed by User on the RateMyStudyAbroad web site, or privately transmitted through the RateMyStudyAbroad web site, are the responsibility of the User from which such informational content has originated. User is fully responsible for any and all informational content that User uploads, posts, e-mails or transmits using the RateMyStudyAbroad web site. RateMyStudyAbroad cannot control all of the informational content Users transmit through the RateMyStudyAbroad web site. Under no circumstances shall RateMyStudyAbroad be held liable for User’s exposure to informational content that User deems offensive, indecent or objectionable. Under no circumstances shall RateMyStudyAbroad be held liable for any errors or omissions in any informational content transmitted by Users.

6.User conduct. User agrees to not use the RateMyStudyAbroad web site to: upload, post, or transmit any informational content that is unlawful, defamatory, vulgar, obscene, libelous, threatens another person or entity, invades the privacy of another or is otherwise objectionable; harm legal minors; collect personal information on, “cyberstalk” or harass another User or engage in conduct that negatively affects the on-line experience of another User; impersonate another User, person or entity, including any official, agent or employee of RateMyStudyAbroad or of any study abroad program; intentionally or unintentionally violate any local, state or federal law, including violations of the Copyright Act; post comments about any study abroad program if User is an employee, agent or official of any study abroad program without identifying User’s study abroad program and the fact that User is an employee, agent or official of such program; forge headers or otherwise manipulate identifiers in order to disguise the origin of any content transmitted through the service; upload, post or transmit any software or files that contain software viruses or other harmful computer code; interfere with the operation of RateMyStudyAbroad’s web servers, other computers, network or the Internet; upload, post or transmit any informational content that is the copyrighted, patented or trademarked intellectual property of another, informational content that constitutes a trade secret or confidential information of another; upload, post or transmit any unsolicited or unauthorized advertising, including “spam” or “junk mail.”

7.RMSA Rights. RateMyStudyAbroad does not pre-screen uploaded, posted or transmitted content, but RateMyStudyAbroad reserves the right to inspect, edit and delete any content that RateMyStudyAbroads knows, or has reason to know, has violated this TOU Agreement. RateMyStudyAbroad reserves the right to immediately and without notice terminate the account of any User found to have violated the provisions of this TOU Agreement. RateMyStudyAbroad may disclose any informational content Users post, upload or transmit to the RateMyStudyAbroad web site if such disclosure is necessary to enforce this TOU Agreement, to respond to claims of intellectual property infringement, to comply with legal process or to protect the rights of RateMyStudyAbroad, the public or other Users.

8.Content submitted by Users. RateMyStudyAbroad does not claim ownership of any informational content submitted by Users to the RateMyStudyAbroad web site. User grants RateMyStudyAbroad a non-exclusive, royalty-free license to use, distribute, reproduce, modify, and publicly display any informational content submitted to the RateMyStudyAbroad web site. This license exists only so long as User allows its content to remain on the RateMyStudyAbroad web site and will terminate in the event that User removes such content.

9.Indemnity. User agrees to indemnify and hold RateMyStudyAbroad and its subsidiaries, affiliates, officers, agents, co-branders or other partners and employees harmless from any claim or demand, including reasonable attorneys’ fees, made by any third party due to or arising out of content User submits, posts, transmits or makes available through the website, User’s use of the website, User’s connection to the website, User’s violation of this TOU Agreement, or User’s violation of any rights of another.

10.No resale. User agrees not to reproduce, copy, duplicate or sell any portion of the RateMyStudyAbroad web site.

11.Limits and modifications. RateMyStudyAbroad may establish, without notice, limits on the use of its web site, including the maximum number of times Users may post to, or participate in, the on-line communities as well as the number of times Users may access the RateMyStudyAbroad web site. RateMyStudyAbroad reserves the right to modify any and all portions of the RateMyStudyAbroad web site without notice. Under no circumstances shall RateMyStudyAbroad be liable to User or any other party for such limits or modifications.

12.Termination of User account. RateMyStudyAbroad may, at its sole discretion, terminate User’s account for any reason. Under no circumstances shall RateMyStudyAbroad be liable to User or any other party for such termination of User’s account.

13.Third party advertisers. RateMyStudyAbroad may allow third party advertisers to advertise on the RateMyStudyAbroad web site. RateMyStudyAbroad takes no responsibility for User’s dealings with any third party advertisers, including any on-line or other purchases from such third parties. RateMyStudyAbroad is not liable for any loss or damage incurred by User in its dealings with third party advertisers.

14.Hyperlink policy. The RateMyStudyAbroad site contains hyperlinks to other Internet sites not under the editorial control of RateMyStudyAbroad. These hyperlinks are not express or implied endorsements or approvals by RateMyStudyAbroad, of any products, services or information available from these sites.

15.RateMyStudyAbroad’s intellectual property rights. User agrees not to distribute, license, or create derivative works from any of RateMyStudyAbroad’s copyrighted or trademarked material, including graphic files and software, available on the RateMyStudyAbroad web site.

16.Limitation of liability. RateMyStudyAbroad, LLC’S MAXIMUM LIABILITY FOR ANY INACCURATE INFORMATION OR SOFTWARE AND USER’S SOLE AND EXCLUSIVE REMEDY FOR ANY CAUSE OF ACTION WHATSOEVER, SHALL BE LIMITED TO THE AMOUNT PAID BY USER FOR THE INFORMATION RECEIVED (IF ANY). RateMyStudyAbroad, LLC IS NOT LIABLE FOR ANY INDIRECT, SPECIAL, INCIDENTAL, OR CONSEQUENTIAL, LOSS OF BUSINESS OR LOSS OF PROFITS, WHETHER BASED ON BREACH OF CONTRACT, BREACH OF WARRANTY, TORT, NEGLIGENCE, PRODUCT LIABILITY OR OTHERWISE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGE.

17.Notice. Notices may be posted to the RateMyStudyAbroad web site or e-mailed to User using the e-mail address User submitted during the registration process.

18.General. This TOU Agreement constitutes the entire agreement between you and RateMyStudyAbroad and governs your use of the RateMyStudyAbroad web site. This TOU Agreement shall be governed by the laws of the State of New York. User agrees to submit to the personal and exclusive jurisdiction of the courts located within the State of New York. The failure of RateMyStudyAbroad to exercise or enforce any right or provision of this TOU Agreement shall not constitute a waiver of such right or provision. If any provision of this TOU Agreement is found by a court of competent jurisdiction to be invalid, the parties nevertheless agree that the court should endeavor to give effect to the parties’ intentions as reflected in the provision and that the other provisions of the TOU Agreement remain in full force and effect. Any claim arising under the terms of this TOU Agreement must be brought within one (1) year after such claim or cause of action arose or be forever barred.

19.Violations. Please report any known or suspected violations of this TOU Agreement by any User, including any suspected copyright or trademark violations, to .henryvw1@gmail.com or jackandrewmartin@gmail.com.

20.No Control Over Other Web Sites. RateMyStudyAbroad, LLC (“RateMyStudyAbroad”) respects the intellectual property and copyrights of others and expects its Users to do the same. RateMyStudyAbroad, however, does not have any responsibility for content on other web sites that may be accessed while using the RateMyStudyAbroad site. These sites may contain copyrighted or otherwise protected information or marks. The TOU of the other web sites, and not RateMyStudyAbroad’s TOU, govern use of that material.

21.Termination of Account for Violations. RateMyStudyAbroad reserves the right to terminate the accounts of Users who may, or actually do, infringe copyrights or other intellectual property rights of RateMyStudyAbroad or others.

22.Notice for Claims of Intellectual Property Violations. If you believe your work has been copied in a way that constitutes copyright infringement, or that your intellectual property rights have otherwise been violated by the RateMyStudyAbroad website, please send the following information to RateMyStudyAbroad’s Copyright Agent:

An electronic or physical signature of the person authorized to act on behalf of the owner of the copyright or other intellectual property interest;

A description of the copyrighted work or other intellectual property that you claim has been infringed;

A detailed description of where the material that you claim is infringing is located on the RateMyStudyAbroad website;

Your address, telephone number, and email address;

A statement that you have a good faith belief the disputed use is not authorized by the copyright or intellectual property owner, its agent or the law;

A statement by you, made under penalty of perjury, that the above information in your Notice is accurate and that you are the copyright or intellectual property owner or authorized to act on the copyright or intellectual property owner’s behalf.

22. Evaluation Tool. Study abroad office and study abroad providers using the RateMyStudyAbroad.com evaluation tool are at any time entitled to export and download the reviews written by their students. This includes the even that the LLC is sold or ceases operation, in the event of which, past reviews will be saved and can be obtained by contacting Henry van Wagenberg (henry@ratemystudyabroad.com).
